International Disputes & Arbitration Law
Osborne Clarke LLP
The interests of today’s corporations, funds, investors, financial institutions, high net-worth individuals, states and state agencies are truly international. Dealing efficiently and effectively with our clients’ disputes against a backdrop of technological and regulatory changes in the global economy is an essential part of our everyday business.
Osborne Clarke deals with disputes worldwide. Our specialist litigation, arbitration, regulatory and investigations lawyers across our international network provide expert representation across the full range of business disputes.
For example, we represent our clients in many complex, high-value disputes before international arbitration tribunals, the courts and in alternative dispute resolution procedures such as mediation. Our priority is always the efficient and cost-effective resolution of disputes with minimal business and reputational disruption.
Our International Arbitration team, led by Greg Fullelove, is experienced in both international commercial and bilateral investment treaty arbitration and has conducted arbitrations under the leading arbitration rules, including those of the LCIA, SCC, ICC, DIS, ICSID and UNCITRAL. We also secure clients’ positions after an award, with a team experienced in dealing with both challenges to the award and enforcing against assets worldwide. We have extensive experience of cases in and/or involving parties from the US, Europe, Africa, the CIS and Latin America
Arbitration is, however, not confined to typical commercial disputes. Foreign investors in particular may have to turn to arbitration as they deal with a changing political and regulatory landscape which impacts their investments. In some cases (for example, when a state expropriates a foreign investor’s assets or acts in an unfair /discriminatory way in respect of an investment), arbitration under an investment treaty may be the only viable option for redress. Foreign investors commonly bring actions against states under one of the more than 3000 bilateral or multilateral investment treaties that exist to protect their rights, including before tribunals constituted under the International Centre for Settlement of Investment Disputes (ICSID) rules.
Growing governmental regulation of renewable energy, digital business and disruptive technologies is causing an increase of disputes in these evolving areas. The Osborne Clarke team has an in-depth understanding of the relevant regulatory, legal and disputes landscapes and provides guidance to clients at each step.
We have similar top-tier expertise in ESG (Environmental, Social and Governance), Net- Zero and climate change issues that are at the top of the agenda for corporations, investor activists and state regulators.
